NCRC TERMS OF USE

Welcome to the National Community Reinvestment Coalition (“NCRC”) website. These terms of use are entered into by and between you and the National Community Reinvestment Coalition (“We,” “Us,” “Our,” or “NCRC”). The following terms and conditions (the “Terms”) govern your access to and use of ncrc.org and any related online services, content, pages, and features offered on or through NCRC’s website (the “Site”).
By using NCRC’s Site, you agree to the following Terms of Use. Please read the Terms carefully before you start using the Site. If you do not want to agree to the Terms of Use and the Privacy Policy found on this Site, you must immediately terminate use of the Site.
About the Website
Our Site and related services (the “Services”) provide information about our organization and may include materials from third parties, such as links, articles, or resources. Content is provided for general informational purposes only.
Changes to the Terms
NCRC may update these Terms from time to time, and we will provide notice of any such changes to the policy as required by law. Your continued use of the Site after changes constitutes your acceptance of the updated Terms. NCRC will notify users of changes to these Terms by updating the "last updated" date and posting the updated Terms on its Site. You should check our Services periodically to see the current policy and any changes we have made to it.

The Site is available only to individuals who can enter into legally binding contracts under applicable law. Creative Common License for NCRC Content
Except as expressly permitted by the Creative Commons license (or as otherwise expressly authorized in writing by NCRC or the applicable rights holder), any reproduction, retransmission, or republication of materials on this Site (in whole or in part) is prohibited. All rights not expressly granted are reserved.
Restrictions on Use of Site Content
Except as expressly permitted by the Creative Commons license described above or otherwise authorized in writing, you may not reproduce, modify, create derivative works from, distribute, sell, transfer, publicly display, publicly perform, transmit, or otherwise use content from the Services.
Notwithstanding the foregoing, you may use content from the Site as a source for your own work, including by quoting limited portions for purposes such as commentary, criticism, news reporting, scholarship, research, or similar informational uses, and by citing or linking to the Services, provided that you do not misattribute the content, imply NCRC endorsement, or use the content in a manner that violates the Creative Commons license or applicable law. You may not copy or modify the HTML or other code used to generate pages on the Services.
No Warranty; No Endorsement
We do not guarantee that any content on the Site or Services is accurate, current, complete, or useful. References to third parties (including links or descriptions of third-party resources) do not constitute endorsement.
Acceptable Use
You agree not to use the Site in a way that violates any applicable law or regulation, or that could harm the Site, Services, our organization, or others. Without limiting the foregoing, you agree not to:

We may access, preserve, and disclose information as we reasonably believe necessary to: (i) comply with applicable law, regulation, legal process, or governmental request; (ii) enforce these Terms; (iii) detect, prevent, or address fraud, security, or technical issues; (iv) respond to support requests; or (v) protect the rights, property, or safety of our organization, users, or the public. We handle such actions consistent with our Privacy Policy and applicable law.
Privacy
We handle personally identifying information in accordance with our Privacy Policy. By using the Site and Services, you agree to the Privacy Policy.
Ownership of the Site and Services
As between you and NCRC, we own the Site, Services, and NCRC‑created content, subject to the Creative Commons license where designated. Third‑party Content is owned by its respective owners. The Site and Services are protected by copyright, trademark, and other laws of the United States and other countries.
Trademarks and Brand Features
Nothing in these Terms grants you any right to use the NCRC name or any NCRC trademarks, service marks, logos, domain names, or other distinctive brand features.
You may not use them without NCRC’s advance written permission, including in any advertising or publicity or in any way that suggests NCRC sponsorship of or affiliation with any product or service. Please contact legal@ncrc.org for any permissions. All other trademarks and logos are the property of their respective owners and may not be used without their permission.
Third-Party Content
The site may include content owned by third parties (“Third-Party Content”). NCRC does not license Third-Party Content to you and is not responsible for it. Your use of Third-Party Content is governed by the applicable third party’s terms and/or rights.
External Links
The Site and Services contain links to other websites and resources. We are not responsible for any of the contents, advertising, products or other materials on such sites, nor do We endorse the content on such sites. Under no circumstances shall We be held responsible or liable, directly or indirectly, for any loss or damages caused or alleged to have been caused by use of or reliance on any content, goods or services available on such sites. Your use of third-party sites is governed by their terms and privacy policies; you should review them carefully. Any concerns regarding any external link should be directed to its respective site administrator or webmaster.
Feedback
Any feedback, comments, or suggestions you provide regarding NCRC or the Site are voluntary, and NCRC may use them for any purpose, without notification nor obligation to you.

Limitation of Liability
To the fullest extent permitted by law, NCRC and its affiliates, and each of their respective officers, directors, employees, agents, and representatives, will not be liable for any loss, injury, or damages arising out of or relating to your use of (or inability to use) the Site or any content, whether based in contract, tort (including negligence), strict liability, or any other legal theory.
Without limiting the foregoing, NCRC will not be liable for: (a) any decision made or action taken in reliance on content made available through the Site; or (b) any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages.
Nothing in these Terms limits liability for willful misconduct, gross negligence, or where prohibited by law.
Indemnification
You agree to indemnify and hold NCRC and its Affiliates, their respective officers, directors, owners, agents and employees, harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Site or Service, the violation of these Terms by you, or the infringement by you, or other user of the Site or Services using your computer, of any intellectual property or other right of any person or entity. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
Termination
NCRC may, in our sole discretion, terminate or suspend your access to all or part of the Site or Services for any reason, including, without limitation, breach of the Terms or any subsequent modifications, or attempted assignment of your account by you. Any suspected fraudulent, abusive or illegal activity may be grounds for termination of your account and may be referred to appropriate law enforcement authorities. We shall not be liable to you or any third party for the termination of your use of the Site or Services or any claims related to the termination of such use.
Governing Law; Jurisdiction and Venue
These Terms are governed by the laws of the District of Columbia, without regard to its conflict-of-law principles, and, to the fullest extent permitted by law, applicable United States intellectual property laws.
To the fullest extent permitted by law, you consent to the personal jurisdiction of and agree that any action will be brought exclusively in, the state and federal courts located in the District of Columbia for any claim arising out of or relating to the Site, the Services, or these Terms.
Time Limit to Bring Claims
To the fullest extent permitted by law, any cause of action or claim arising out of or relating to the Site, the Services, or these Terms must be commenced within one (1) year after the claim accrues; otherwise, it is permanently barred, except where a longer period is required by applicable law and cannot be waived or shortened by agreement.
Entire Agreement
These Terms, together with any documents incorporated by reference, constitute the final, complete, and exclusive agreement between you and NCRC regarding the Site and the Services and supersede all prior and contemporaneous agreements, negotiations, and representations on that subject. These Terms do not govern any other transactions or agreements between you and NCRC unrelated to the Site or the Services.
Assignment
You may not assign your rights or obligations under these Terms. Any attempted assignment of your account is grounds for suspension or termination. We may assign our rights and obligations in accordance with applicable law.
Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, it will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.
Sole Remedy
Should you object to any terms and conditions of these Terms or any subsequent changes to the terms and conditions or become dissatisfied with the Service in any way, your only recourse is to immediately: (1) discontinue use of the Site and Services and (2) terminate accounts, if any. Continued use of the Site or Services is an acceptance of the Terms and all or any subsequent changes.
